The Best Ways To Avoid A Liquor License Violation

By Betty Nelson

Owners of restaurants, bars, grocery and quick shop stores have to apply for licenses before they can sell any kind of alcohol. Many business owners believe it is important for them to get approval because they feel the ability to sell alcohol will significantly increase their profits. Usually a city, such as New Mexico, has to vote on approval, and there are a number of things that go into their decision. The probability of the business committing a liquor license violation is one of them.

Not every state has the same laws when it comes to distributing alcohol, but one that is fairly universal concerns selling it to minors. If you knowingly allow an underage person to purchase alcohol of any kind, you will have your permit revoked and may not be able to get it reinstated. Even if they show proof of age, you might still have concerns. If you have any question at all about whether someone is old enough to buy alcohol, you should refuse to sell them a bottle or a drink.

You have a responsibility to refuse service to anyone who is intoxicated. He or she might try to convince you they are fine, but you clearly know they are not. When you allow them to continue to drink in your establishment or buy a bottle in your package store, you will be held liable if they get into an accident and hurt someone.

In most cases, businesses that sell alcohol are not allowed to have gambling machines or let people play cards and other games for money. This does not apply to the sale of lottery tickets however, in the states that participate in that activity. Whether or not you can provide entertainment in a place where alcohol is sold depends on the type of license you have.

Disagreements in bars are not unusual, but you must take measures to see that you are running an establishment with a no tolerance rule. Offenders should be ejected and ordered off the property. If you have too many disruptions at your business, your permits might be revoked. Illegal drugs can never be permitted if you want to keep your business open.

Having a contest with the prize being a free round of drinks may seem like a good promotion and a way to get customers into your place of business, but it is illegal in some states. It can also be a violation to allow customers to run a bar tab.

Of course you should never try to get a permit for anyone else. If you decide to remodel your establishment, whether making it bigger or smaller, you will have to get approval and your permit rules may change. Individuals who are convicted of a felony will have licenses revoked. Not complying with law enforcement can also result in a revocation of your permit as well.

Before you start selling alcohol, either by the bottle or by the drink, you should clearly understand what is allowed and what is not. Your business may depend on it.
